{"id":100602,"date":"2026-09-04T01:55:28","date_gmt":"2026-09-03T23:55:28","guid":{"rendered":"https:\/\/congopubonline.com\/?p=100602"},"modified":"2026-09-04T01:55:30","modified_gmt":"2026-09-03T23:55:30","slug":"rdc-la-perpetuite-requise-contre-le-lieutenant-general-philemon-yav-pour-trahison","status":"publish","type":"post","link":"https:\/\/congopubonline.com\/?p=100602","title":{"rendered":"RDC : la perp\u00e9tuit\u00e9 requise contre le lieutenant-g\u00e9n\u00e9ral Phil\u00e9mon Yav pour trahison"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Le minist\u00e8re public a requis, jeudi 3 septembre 2026, la <strong>servitude p\u00e9nale \u00e0 perp\u00e9tuit\u00e9<\/strong> contre le lieutenant-g\u00e9n\u00e9ral <strong>Phil\u00e9mon Yav Irung<\/strong>, poursuivi devant la Haute Cour militaire pour plusieurs infractions, dont la trahison et la participation \u00e0 un mouvement insurrectionnel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans son r\u00e9quisitoire, l\u2019auditeur g\u00e9n\u00e9ral des <strong>FARDC<\/strong> a demand\u00e9 \u00e0 la Haute Cour militaire de d\u00e9clarer \u00e9tablies les charges retenues contre Phil\u00e9mon Yav et son copr\u00e9venu, le major <strong>Shauri<\/strong>. Le parquet a toutefois sollicit\u00e9 l\u2019application des <strong>circonstances att\u00e9nuantes<\/strong> en leur faveur, malgr\u00e9 la peine maximale requise.<\/p>\n\n\n\n<h3 id=\"h-des-contacts-presumes-avec-l-afc-m23\" class=\"wp-block-heading\"><strong>Des contacts pr\u00e9sum\u00e9s avec l\u2019AFC\/M23<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019accusation reproche notamment \u00e0 l\u2019ancien commandant de la troisi\u00e8me zone de d\u00e9fense d\u2019avoir entretenu des contacts pr\u00e9sum\u00e9s avec des responsables li\u00e9s \u00e0 l\u2019<strong>AFC\/M23<\/strong> et d\u2019avoir particip\u00e9 \u00e0 des actes qui auraient vis\u00e9 la d\u00e9stabilisation des institutions de la R\u00e9publique.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le dossier \u00e9voque \u00e9galement des contacts suppos\u00e9s avec l\u2019entourage du g\u00e9n\u00e9ral rwandais <strong>James Kabarebe<\/strong>, ainsi que la fourniture pr\u00e9sum\u00e9e d\u2019armes et de munitions aux insurg\u00e9s du M23, notamment au groupe d\u00e9sign\u00e9 dans le dossier sous le nom de <strong>\u00ab Twira Neho \u00bb<\/strong>.<\/p>\n\n\n\n<h3 id=\"h-la-defense-rejette-les-accusations\" class=\"wp-block-heading\"><strong>La d\u00e9fense rejette les accusations<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ces accusations sont contest\u00e9es par la d\u00e9fense, qui estime qu\u2019aucun \u00e9l\u00e9ment mat\u00e9riel ne permet d\u2019\u00e9tablir les faits reproch\u00e9s \u00e0 son client.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lors des pr\u00e9c\u00e9dentes audiences, Phil\u00e9mon Yav avait rejet\u00e9 l\u2019ensemble des charges port\u00e9es contre lui. En ao\u00fbt dernier, confront\u00e9 aux d\u00e9clarations de certains t\u00e9moins, il s\u2019\u00e9tait dit \u00ab surpris et d\u00e9shonor\u00e9 \u00bb par leurs d\u00e9positions. Ses avocats avaient \u00e9galement remis en cause les expertises r\u00e9alis\u00e9es \u00e0 partir de ses t\u00e9l\u00e9phones professionnels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Arr\u00eat\u00e9 en septembre 2022 alors qu\u2019il commandait la troisi\u00e8me zone de d\u00e9fense des FARDC, Phil\u00e9mon Yav est jug\u00e9 dans une proc\u00e9dure impliquant plusieurs officiers sup\u00e9rieurs de l\u2019arm\u00e9e congolaise.<\/p>\n\n\n\n<h3 id=\"h-la-cour-doit-desormais-deliberer\" class=\"wp-block-heading\"><strong>La Cour doit d\u00e9sormais d\u00e9lib\u00e9rer<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Apr\u00e8s les r\u00e9quisitions du minist\u00e8re public, la d\u00e9fense doit pr\u00e9senter ses derni\u00e8res observations avant le d\u00e9lib\u00e9r\u00e9 de la Haute Cour militaire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La peine requise par le parquet <strong>ne constitue pas une condamnation<\/strong>.
