L\u2019Assembl\u00e9e nationale a adopt\u00e9, vendredi 23 octobre 2026, la loi organique fixant les conditions d\u2019organisation du r\u00e9f\u00e9rendum en R\u00e9publique d\u00e9mocratique du Congo. Le texte a \u00e9t\u00e9 approuv\u00e9 apr\u00e8s l\u2019int\u00e9gration des r\u00e9serves formul\u00e9es par la Cour constitutionnelle dans sa d\u00e9cision du 28 juillet 2026.<\/p>\n\n\n\n

Cette adoption intervient dans un contexte de d\u00e9bat politique autour d\u2019une \u00e9ventuelle modification de la Constitution. Le texte doit d\u00e9sormais \u00eatre transmis au S\u00e9nat pour une seconde lecture avant de poursuivre la proc\u00e9dure conduisant \u00e0 sa promulgation par le pr\u00e9sident de la R\u00e9publique, F\u00e9lix Tshisekedi.<\/p>\n\n\n\n

Que pr\u00e9voit cette loi ?<\/strong><\/h3>\n\n\n\n

Compos\u00e9e de 45 articles r\u00e9partis en huit chapitres, selon les informations fournies, la loi vise \u00e0 \u00e9tablir un cadre juridique pour l\u2019organisation des r\u00e9f\u00e9rendums en RDC. Elle pr\u00e9cise les conditions de lancement d\u2019une consultation populaire, les modalit\u00e9s de son organisation ainsi que les m\u00e9canismes de recours en cas de contestation.<\/p>\n\n\n\n

Le texte pr\u00e9voit plusieurs voies d\u2019initiative, notamment le pr\u00e9sident de la R\u00e9publique, le gouvernement, chacune des deux chambres du Parlement, sous certaines conditions, ainsi qu\u2019une p\u00e9tition r\u00e9unissant 100 000 citoyens.<\/p>\n\n\n\n

La Commission \u00e9lectorale nationale ind\u00e9pendante (CENI) est appel\u00e9e \u00e0 organiser le scrutin, tandis que la convocation du corps \u00e9lectoral rel\u00e8ve du pr\u00e9sident de la R\u00e9publique, conform\u00e9ment \u00e0 la proc\u00e9dure pr\u00e9vue par la loi. La Cour constitutionnelle est charg\u00e9e de conna\u00eetre du contentieux relatif au r\u00e9f\u00e9rendum.<\/p>\n\n\n\n

Une consultation sur des questions fondamentales<\/strong><\/h3>\n\n\n\n

Le champ d\u2019application de la loi couvre notamment les questions jug\u00e9es fondamentales pour la nation, la r\u00e9vision constitutionnelle, le transfert de la capitale ainsi que certaines questions relatives au territoire national.<\/p>\n\n\n\n

Le texte adopt\u00e9 pr\u00e9voit \u00e9galement la possibilit\u00e9 de soumettre au r\u00e9f\u00e9rendum des modifications constitutionnelles, y compris celles touchant aux dispositions auxquelles les pouvoirs constitu\u00e9s ne peuvent normalement pas porter atteinte, ainsi que l\u2019adoption \u00e9ventuelle d\u2019une nouvelle Constitution.<\/p>\n\n\n\n

Cette disposition constitue l\u2019un des principaux enjeux du texte. Elle s\u2019appuie, selon les \u00e9l\u00e9ments communiqu\u00e9s, sur l\u2019article 5 de la Constitution et sur l\u2019interpr\u00e9tation retenue par la Cour constitutionnelle dans ses arr\u00eats de janvier 2021 et de juillet 2026.<\/p>\n\n\n\n

La port\u00e9e de ces dispositions devra toutefois \u00eatre appr\u00e9ci\u00e9e \u00e0 la lumi\u00e8re du texte d\u00e9finitif, des d\u00e9cisions de la Cour constitutionnelle et des limites pr\u00e9vues par la Constitution.<\/p>\n\n\n\n

Le 28 juillet 2026, la Cour constitutionnelle avait d\u00e9clar\u00e9 la loi conforme \u00e0 la Constitution, sous r\u00e9serve de modifications concernant 13 articles. Ces r\u00e9serves portaient notamment sur la vulgarisation du texte, l\u2019encadrement de la campagne r\u00e9f\u00e9rendaire, l\u2019utilisation des moyens de l\u2019\u00c9tat et les recours contre les r\u00e9sultats.<\/p>\n\n\n\n

L\u2019int\u00e9gration de ces observations a permis \u00e0 l\u2019Assembl\u00e9e nationale de proc\u00e9der \u00e0 une nouvelle adoption du texte.<\/p>\n\n\n\n

Un d\u00e9bat politique appel\u00e9 \u00e0 se poursuivre<\/strong><\/h3>\n\n\n\n

Si cette loi doit permettre \u00e0 la RDC de disposer d\u2019un cadre juridique plus complet pour l\u2019organisation des r\u00e9f\u00e9rendums, son adoption intervient alors que la question d\u2019une \u00e9ventuelle r\u00e9vision constitutionnelle suscite des divergences entre les acteurs politiques.<\/p>\n\n\n\n

Elle ne signifie pas, \u00e0 elle seule, qu\u2019un r\u00e9f\u00e9rendum est convoqu\u00e9 ni qu\u2019une modification de la Constitution est automatiquement engag\u00e9e. Une telle consultation devra suivre les proc\u00e9dures l\u00e9gales applicables.<\/p>\n\n\n\n

Apr\u00e8s son examen par le S\u00e9nat et l\u2019ach\u00e8vement de la proc\u00e9dure l\u00e9gislative, le texte pourra \u00eatre transmis au pr\u00e9sident de la R\u00e9publique pour promulgation. Son contenu d\u00e9finitif et ses modalit\u00e9s d\u2019application seront d\u00e9terminants pour comprendre les conditions dans lesquelles un r\u00e9f\u00e9rendum pourrait \u00eatre organis\u00e9 en RDC.<\/p>\n\n\n\n
