Proc\u00e9dure devant la cour constitutionnelle congolaise : Esquive judiciaire ou politique ? est une r\u00e9flexion sur la primaut\u00e9 du droit subjectif sur le droit substantiel, avec pour cons\u00e9quence proc\u00e9durale, l\u2019abandon par le juge de l\u2019examen du fond de l\u2019objet en cause suite au d\u00e9faut de qualit\u00e9 du requ\u00e9rant ou du manque de son lien d\u2019int\u00e9r\u00eat \u00e0 celui-ci : pr\u00e9dominance de la forme sur le fond.<\/strong><\/p>\n\n\n\n

Pour l\u2019auteur, la forme ne peut d\u00e9terminer ni sublimer le fond, mais l\u2019inverse est vrai. Les esquives judiciaires d\u2019irrecevabilit\u00e9 de requ\u00eates pour d\u00e9faut de qualit\u00e9 de sujets comme cons\u00e9quence de la logique proc\u00e9durale, l\u2019abandon de l\u2019examen de fond, la d\u00e9licatesse politique pour d\u00e9cliner ses comp\u00e9tences n\u2019am\u00e8nent pas la Cour Constitutionnelle \u00e0 vider le contentieux.<\/p>\n\n\n\n

Bien au contraire, elle peut nourrir les risques r\u00e9fractaires, r\u00e9actionnaires ou r\u00e9volutionnaires peu souhaitables pour la paix sociale et civile, la construction d\u2019un \u00c9tat de droit et l\u2019instauration de la d\u00e9mocratie.<\/p>\n\n\n\n
