Un juge a fait sensation en Colombie en annon\u00e7ant avoir utilis\u00e9 le chatbot d’intelligence artificielle ChatGPT pour statuer sur une affaire concernant un enfant autiste, a-t-on appris jeudi de sources concordantes.<\/strong><\/p>\n\n\n\n

\u00ab\u00a0Cela ouvre des perspectives immenses, aujourd’hui \u00e7a peut \u00eatre ChatGPT, mais dans trois mois \u00e7a pourrait \u00eatre n’importe quelle autre alternative pour faciliter la r\u00e9daction de textes juridiques sur laquelle le juge peut s’appuyer\u00a0\u00bb<\/em>, a d\u00e9clar\u00e9 le juge Juan Manuel Padilla<\/strong>, sur une radio locale. \u00ab\u00a0Le but n’est cependant pas de remplacer les juges\u00a0\u00bb<\/em>, a-t-il soulign\u00e9.<\/p>\n\n\n\n

Dans une d\u00e9cision du 30 janvier, il a statu\u00e9 sur la demande d’une m\u00e8re qui souhaitait que son fils autiste<\/strong> soit exempt\u00e9 du paiement des rendez-vous m\u00e9dicaux<\/strong>, des traitements et du transport vers des centres hospitaliers, la famille ne disposant pas des ressources financi\u00e8res n\u00e9cessaires pour les payer.<\/p>\n\n\n\n

M. Padilla a tranch\u00e9 en faveur de l’enfant et indiqu\u00e9 dans son jugement avoir interrog\u00e9 le chatbot ChatGPT<\/strong> pour rendre sa d\u00e9cision.<\/p>\n\n\n\n

\u00ab\u00a0Le mineur autiste est-il dispens\u00e9 de payer des frais de mod\u00e9ration pour ses th\u00e9rapies ?\u00a0\u00bb<\/em>, a demand\u00e9 le juge, selon la transcription de sa d\u00e9cision. Et l’application a r\u00e9pondu : \u00ab\u00a0Oui, c’est exact. Selon la loi en vigueur en Colombie, les mineurs ayant re\u00e7u un diagnostic d’autisme sont exempt\u00e9s du paiement de frais de mod\u00e9ration pour leurs th\u00e9rapies\u00a0\u00bb<\/em>.<\/p>\n\n\n\n

\u00ab\u00a0Les juges ne sont pas des imb\u00e9ciles, ce n’est pas parce que nous posons des questions \u00e0 l’application que nous cessons d’\u00eatre des juges, des \u00eatres pensants\u00a0\u00bb<\/em>, a comment\u00e9 M. Padilla.<\/p>\n\n\n\n

Selon lui, ChatGPT fait aujourd’hui ce qui \u00e9tait auparavant assur\u00e9 par \u00ab\u00a0une secr\u00e9taire\u00a0\u00bb<\/em>, \u00ab\u00a0de mani\u00e8re organis\u00e9e, simple et structur\u00e9e\u00a0\u00bb<\/em>, ce qui \u00ab\u00a0pourrait am\u00e9liorer les temps de r\u00e9ponse dans le secteur judiciaire\u00a0\u00bb<\/em>.<\/p>\n\n\n\n

Ces d\u00e9clarations ont suscit\u00e9 un vif d\u00e9bat. <\/p>\n\n\n\n

Le professeur Juan David Guti\u00e9rrez<\/strong>, de l’Universit\u00e9 Rosario, a notamment expliqu\u00e9 avoir re\u00e7u des r\u00e9ponses diff\u00e9rentes apr\u00e8s avoir pos\u00e9 les m\u00eames questions. \u00ab\u00a0Comme pour d’autres IA dans d’autres domaines, sous le pr\u00e9texte d’une efficacit\u00e9 suppos\u00e9e, les droits fondamentaux sont mis en danger\u00a0\u00bb<\/em>, a-t-il mis en garde.<\/p>\n\n\n\n

L’intelligence artificielle<\/strong> ChatGPT fait sensation dans le monde depuis novembre. Cr\u00e9\u00e9 par la soci\u00e9t\u00e9 californienne OpenAI<\/strong>, le robot conversationnel ChatGPT fonctionne sur la base d’algorithmes<\/strong> et d’immenses bases de donn\u00e9es.<\/p>\n\n\n\n

Elle produit des textes sur simple requ\u00eate, pouvant servir notamment \u00e0 des avocats, des ing\u00e9nieurs ou encore des journalistes<\/strong>, avec des risques de manipulation ou de d\u00e9sinformation.<\/p>\n\n\n\n
