En cause, les propos tenus par le journaliste dans une \u00e9mission t\u00e9l\u00e9vis\u00e9e, au cours de laquelle, il affirmait que le chanteur n\u2019avait pas sign\u00e9 de contrat avec Vivendi pour la production de son spectacle lors des IXes Jeux de la Francophonie \u00e0 Kinshasa.<\/strong><\/p>\n\n\n\n<p>Cette affaire soul\u00e8ve la question de la libert\u00e9 d\u2019expression du journaliste. En effet, le journaliste a le droit d\u2019enqu\u00eater et rapporter des informations, m\u00eame si elles sont critiques ou d\u00e9favorables \u00e0 une personnalit\u00e9 publique. Cependant, il ne peut pas tenir des propositions diffamatoires.<\/p>\n\n\n\n<p>La diffamation est le fait de porter atteinte \u00e0 l\u2019honneur ou \u00e0 la consid\u00e9ration d\u2019une personne en lui imputant des faits qui ne sont pas vrais. Dans le cas d\u2019esp\u00e8ce, les propos tenues par Gauthier Sey sont susceptibles de porter atteinte \u00e0 l\u2019honneur et \u00e0 la consid\u00e9ration de Fally Ipupa, car il le pr\u00e9sentent comme un menteur et un escroc.<\/p>\n\n\n\n<p>Il est important de rappeler que la libert\u00e9 d\u2019expression n\u2019est pas un droit absolu. Elle s\u2019exerce dans le cadre de la loi, qui interdit notamment la diffamation.<\/p>\n\n\n\n<p>Dans cette affaire, il appartiendra au tribunal de d\u00e9cider si les propos tenus par Gauthier Sey sont diffamatoires ou non.
