La justice fran\u00e7aise a \u00e9mis un mandat d’arr\u00eat international contre Bachar al-Assad, ont annonc\u00e9, mercredi, des plaignants. Le pr\u00e9sident syrien est accus\u00e9 de complicit\u00e9 de crimes contre l’humanit\u00e9 pour les attaques chimiques perp\u00e9tr\u00e9es \u00e0 l’\u00e9t\u00e9 2013 en Syrie.<\/strong><\/p>\n\n\n\n

Bachar al-Assad dans le viseur de la justice fran\u00e7aise. Des plaignants ont annonc\u00e9, mercredi 15 novembre, qu’un mandat d’arr\u00eat international a \u00e9t\u00e9 \u00e9mis mardi contre le pr\u00e9sident syrien, accus\u00e9 de complicit\u00e9 de crimes contre l’humanit\u00e9 pour les attaques chimiques perp\u00e9tr\u00e9es \u00e0 l’\u00e9t\u00e9 2013 en Syrie.<\/p>\n\n\n\n

Une source judiciaire a confirm\u00e9 l’\u00e9mission de quatre mandats d’arr\u00eat pour complicit\u00e9 de crimes contre l’humanit\u00e9 et pour complicit\u00e9 de crimes de guerre pour ces attaques au gaz sarin, qui avaient notamment fait plus de 1 000 morts dans la Ghouta orientale<\/a> le 21 ao\u00fbt 2013, selon les renseignements am\u00e9ricains. <\/p>\n\n\n\n

Ces mandats visent \u00e9galement le fr\u00e8re redout\u00e9 de Bachar al-Assad, Maher, chef de facto de la Quatri\u00e8me division \u2013 unit\u00e9 d’\u00e9lite de l’arm\u00e9e syrienne \u2013 ainsi que deux g\u00e9n\u00e9raux, Ghassan Abbas, directeur de la branche 450 du CERS, et Bassam al-Hassan, officier de liaison et chef de la s\u00e9curit\u00e9.<\/p>\n\n\n\n

Des juges d’instruction du p\u00f4le crimes contre l’humanit\u00e9 du Tribunal judiciaire de Paris enqu\u00eatent depuis avril 2021 sur ces attaques chimiques perp\u00e9tr\u00e9es en 2013 en Syrie et imput\u00e9es au r\u00e9gime de Bachar al-Assad.<\/p>\n\n\n\n

L’enqu\u00eate avait \u00e9t\u00e9 ouverte apr\u00e8s une plainte avec constitution de partie civile par le Centre syrien pour les m\u00e9dias et la libert\u00e9 d’expression (SCM), Open Society Justice Initiative (OSJI) et Syrian Archive.<\/p>\n\n\n\n

\u00ab\u00a0Un pr\u00e9c\u00e9dent judiciaire historique\u00a0\u00bb<\/h4>\n\n\n\n

Ces investigations, men\u00e9es au titre de la \u00ab\u00a0comp\u00e9tence extraterritoriale\u00a0\u00bb de la justice fran\u00e7aise, portent \u00e9galement sur les attaques perp\u00e9tr\u00e9es dans la nuit du 4 au 5 ao\u00fbt \u00e0 Adra et Douma \u2013 450 bless\u00e9s.<\/p>\n\n\n\n

\u00ab\u00a0Cette d\u00e9cision constitue un pr\u00e9c\u00e9dent judiciaire historique. C’est une nouvelle victoire pour les victimes, leurs familles et les survivants, ainsi qu’un pas vers la justice et une paix durable en Syrie\u00a0\u00bb, a r\u00e9agi dans un communiqu\u00e9 Mazen Darwish, fondateur et directeur g\u00e9n\u00e9ral du SCM.<\/p>\n\n\n\n

Il rappelle que la plainte \u00e9tait accompagn\u00e9e de \u00ab\u00a0t\u00e9moignages de premi\u00e8re main venant de nombreuses victimes\u00a0\u00bb, d’une \u00ab\u00a0analyse approfondie de la cha\u00eene de commandement militaire syrienne\u00a0\u00bb, ainsi que \u00ab\u00a0de centaines de documents, parmi lesquels des photos et vid\u00e9os\u00a0\u00bb.<\/p>\n\n\n\n

Le r\u00e9gime syrien est la cible de plusieurs actions en justice lanc\u00e9es en Europe, en particulier en Allemagne.<\/p>\n\n\n\n

En France, le premier proc\u00e8s de responsables du r\u00e9gime syrien aura lieu du 21 au 24 mai \u00e0 Paris : trois hauts responsables du r\u00e9gime de Bachar al-Assad seront jug\u00e9s pour complicit\u00e9 de crimes contre l’humanit\u00e9 et de d\u00e9lit de guerre, pour la mort de deux citoyens franco-syriens, Mazzen Dabbagh et son fils Patrick, arr\u00eat\u00e9s en 2013.<\/p>\n\n\n\n

Dans une autre proc\u00e9dure, concernant un bombardement \u00e0 Deraa en 2017, des mandats d’arr\u00eat ont \u00e9t\u00e9 \u00e9mis en octobre contre quatre ex-hauts dirigeants de l’arm\u00e9e syrienne.<\/p>\n\n\n\n

D\u00e9clench\u00e9 en 2011, le conflit en Syrie a fait plus d’un demi-million de morts et morcel\u00e9 le pays.<\/p>\n\n\n\n
