{"id":70290,"date":"2024-08-06T12:20:13","date_gmt":"2024-08-06T10:20:13","guid":{"rendered":"https:\/\/congopubonline.com\/?p=70290"},"modified":"2024-08-06T12:24:08","modified_gmt":"2024-08-06T10:24:08","slug":"justice-la-cour-dappel-kinshasa-gombe-se-declare-competente-pour-juger-mike-mukebay","status":"publish","type":"post","link":"https:\/\/congopubonline.com\/?p=70290","title":{"rendered":"Justice : la cour d\u2019appel Kinshasa-Gombe se d\u00e9clare comp\u00e9tente pour juger Mike Mukebay"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Dans son arr\u00eat rendu public le lundi 5 ao\u00fbt 2024, la Cour d\u2019appel de Kinshasa\/Gombe s\u2019est d\u00e9clar\u00e9e comp\u00e9tente pour juger Mike Mukebayi Nkoso d\u00e9tenu depuis plusieurs \u00e0 la prison centrale de Makala.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour a not\u00e9 que le pr\u00e9venu, n\u2019\u00e9tant plus d\u00e9put\u00e9 provincial avec le d\u00e9but d\u2019une nouvelle l\u00e9gislature, ne jouit plus du privil\u00e8ge de juridiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab\u00a0<em>Non seulement que la Cour d\u2019appel de Kin\/Gombe a rendu son arr\u00eat sur l\u2019exception d\u2019incomp\u00e9tence soulev\u00e9e par le Conseil de Mike Mukebayi au-del\u00e0 du d\u00e9lai l\u00e9gal, mais la m\u00eame Cour vient de rejeter cette exception au motif que les faits se sont cristallis\u00e9s lorsqu\u2019il avait encore la qualit\u00e9 de d\u00e9put\u00e9 provincial. Toutefois, la Cour d\u2019appel a reconnu que le m\u00eame Conseil a soulev\u00e9 des pr\u00e9alables sur les circonstances de son arrestation, qu\u2019il a estim\u00e9 irr\u00e9guli\u00e8res. Curieusement, bien que se d\u00e9clarant comp\u00e9tente, la Cour s\u2019est abstenue de r\u00e9server une suite auxdits pr\u00e9alables renvoyant seulement l\u2019affaire en prospection pour son audience en foraine \u00e0 la prison de Makala ce vendredi 9 ao\u00fbt 2024\u00a0<\/em>\u00bb, a soulign\u00e9 son avocat conseil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il faut noter sur ce cadre du parti Ensemble pour la R\u00e9publique est poursuivi notamment pour propagation de faux bruits, imputations dommageables et offense au chef de l\u2019\u00c9tat.<\/p>\n\n\n\n<p
