L&rsquo;ouvrage analyse aussi quelques cas pratiques dont la prise en compte sugg\u00e8re de nouvelles perspectives pour un \u00e9ventuel r\u00e9ajustement de la r\u00e9forme ainsi op\u00e9r\u00e9e.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La libert\u00e9 d\u2019acc\u00e8s \u00e0 la commande publique proc\u00e8de des principes constitutionnels d\u2019\u00e9galit\u00e9 des citoyens devant la loi et de la libre concurrence. La libert\u00e9 d\u2019entreprendre, l\u2019\u00e9galit\u00e9 de traitement des candidats, la transparence de la proc\u00e9dure\u2026, tels sont les principes fondamentaux qui gouvernent tout processus de passation des march\u00e9s publics en R\u00e9publique d\u00e9mocratique du Congo et s\u2019imposent aux acheteurs publics. Ils concourent \u00e0 \u00e9radiquer le fl\u00e9au qui gangr\u00e8ne les march\u00e9s publics et, en g\u00e9n\u00e9ral, la gestion des finances publiques :la corruption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En ce qui les concerne, interdiction est faite aux entrepreneurs, aux fournisseurs et aux prestataires de services, de commettre certains actes, qualifi\u00e9s d\u2019improbes, dans la passation ou dans l\u2019ex\u00e9cution des march\u00e9s publics, sous peine des sanctions administratives et ce, sans pr\u00e9judice des peines pr\u00e9vues par la loi p\u00e9nale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans le pr\u00e9sent ouvrage sur le Droit congolais des march\u00e9s publics, il est fait l\u2019autopsie de tous ces principes fondamentaux, et l\u2019auteur livre au lecteur une analyse prospective de l\u2019ensemble de la r\u00e9glementation consacr\u00e9e dans ce secteur capital de la vie nationale, depuis la r\u00e9forme op\u00e9r\u00e9e par la loi n\u00b0 10\/010 du 27 avril 2010 relative aux march\u00e9s publics.
