En France, deux juges d’instruction parisiens ont ordonn\u00e9 mercredi 21 ao\u00fbt un non-lieu concernant Agathe Habyarimana, la veuve de l’ancien pr\u00e9sident rwandais hutu, Juv\u00e9nal Habyarimana. Le parquet national antiterroriste demandait sa mise en examen pour entente en vue de la commission du g\u00e9nocide des Tutsis en 1994. Mais les juges d’instruction persistent \u00e0 penser que cette mise en examen n’est pas n\u00e9cessaire.<\/p>\n\n\n\n

L’ordonnance, que l\u2019Agence France-Presse a pu consulter, est dat\u00e9e de mercredi 21 ao\u00fbt. Les juges y estiment qu\u2019il \u00ab n’existe pas de charges suffisantes <\/em>\u00bb contre Agathe Habyarimana, \u00ab qu’elle ait pu \u00eatre complice d’actes de g\u00e9nocide <\/em>\u00bb ou qu\u2019elle ait pu \u00ab participer \u00e0 une entente en vue de commettre le g\u00e9nocide<\/em> \u00bb.<\/p>\n\n\n\n

\u00c0 ce jour, poursuivent les juges, Agathe Habyarimana<\/strong><\/a> \u00ab appara\u00eet non comme auteure de g\u00e9nocide, mais bien comme une victime<\/em> \u00bb de l’attentat terroriste dans lequel ont \u00e9t\u00e9 tu\u00e9s son mari, son fr\u00e8re et des proches.<\/p>\n\n\n\n

La perspective d’un proc\u00e8s pour Agathe Habyarimana s’\u00e9loigne donc fortement, alors que cette affaire a donn\u00e9 lieu \u00e0 un v\u00e9ritable bras de fer entre les juges d’instruction et le parquet national antiterroriste. Ce jeudi 21 ao\u00fbt, le parquet national antiterroriste (Pnat) a indiqu\u00e9 qu’il allait faire appel. Le Pnat \u00ab entend relever appel de cette d\u00e9cision, rendue alors m\u00eame qu’un recours <\/em>\u00bb doit \u00eatre examin\u00e9, explique le minist\u00e8re public \u00e0 l’AFP. Le 15 mai 2025, les juges avaient d\u00e9j\u00e0 rendu une ordonnance exposant leur point de vue.<\/p>\n\n\n\n

Selon les associations de victimes, Agathe Habyarimana \u00e9tait l’une des dirigeantes de l\u2019\u00ab\u00a0akazu\u00a0<\/em>\u00bb, le premier cercle du pouvoir hutu qui a orchestr\u00e9 le\u00a0g\u00e9nocide des Tutsis\u00a0en 1994. Ce qu\u2019elle r\u00e9fute.<\/p>\n\n\n\n

Philibert Gakwenzir\u00e9, pr\u00e9sident de l’association Ibuka, esp\u00e8re que le travail de la justice fran\u00e7aise va se poursuivre. \u00ab Le cas d’Agathe Habyarimana dans la pers\u00e9cution des Tutsis depuis un certain temps est tr\u00e8s connu. Et il n’y a pas \u00e0 douter de sa position dans l’akazu dirigeant le pays. Tout est \u00e0 examiner et \u00e0 remettre dans son contexte. En France, il y a eu pas mal d’ann\u00e9es de silence. S’il y a que pour l’instant des rebondissements, il faut continuer sur le m\u00eame \u00e9lan. <\/em>\u00bb<\/p>\n\n\n\n

C’est une d\u00e9marche judiciaire qui s’appuie sur les normes juridiques. En revanche, les historiens peuvent consid\u00e9rer qu’\u00e0 partir des archives que la commission dite Duclert que nous avons consult\u00e9, que Agatha Habyarimana a pris une part tr\u00e8s active \u00e0 la pr\u00e9paration du g\u00e9nocide, \u00e0 son d\u00e9clenchement et \u00e0 son paroxysme.<\/p>\n<\/blockquote>\n\n\n\n
