{"id":88166,"date":"2025-08-29T08:23:20","date_gmt":"2025-08-29T06:23:20","guid":{"rendered":"https:\/\/congopubonline.com\/?p=88166"},"modified":"2025-08-29T08:23:20","modified_gmt":"2025-08-29T06:23:20","slug":"justice-la-cour-constitutionnelle-se-declare-incompetente-pour-statuer-sur-le-recours-de-matata-ponyo","status":"publish","type":"post","link":"https:\/\/congopubonline.com\/?p=88166","title":{"rendered":"Justice : La Cour constitutionnelle se d\u00e9clare incomp\u00e9tente pour statuer sur le recours de Matata Ponyo"},"content":{"rendered":"\n<p>La Cour constitutionnelle de la RDC s\u2019est d\u00e9clar\u00e9e incomp\u00e9tente ce jeudi pour examiner le recours en inconstitutionnalit\u00e9 d\u00e9pos\u00e9 par l\u2019ancien Premier ministre Augustin Matata Ponyo, condamn\u00e9 en mai dernier \u00e0 10 ans de travaux forc\u00e9s pour d\u00e9tournement de fonds publics.<\/p>\n\n\n\n<p>L\u2019ancien chef du gouvernement (2012-2016) contestait sa condamnation, rendue le 20 mai par cette m\u00eame Cour, en invoquant la violation de plusieurs articles constitutionnels, notamment :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019article 168 relatif aux comp\u00e9tences de la Cour constitutionnelle ;<\/li>\n\n\n\n<li>Les articles 107 et 166 concernant l\u2019immunit\u00e9 et les poursuites contre un d\u00e9put\u00e9 national.<\/li>\n<\/ul>\n\n\n\n<p>La Haute Cour a estim\u00e9 que sa d\u00e9cision pr\u00e9c\u00e9dente ne pouvait faire l\u2019objet d\u2019un recours, confirmant ainsi le principe d\u2019autorit\u00e9 de la chose jug\u00e9e dont ses arr\u00eats sont normalement rev\u00eatus.<\/p>\n\n\n\n<p>Matata Ponyo avait \u00e9t\u00e9 reconnu coupable d\u2019avoir d\u00e9tourn\u00e9 plus de 245 millions de dollars am\u00e9ricains \u2013 dont 156 millions destin\u00e9s au parc agro-industriel de Bukanga-Lonzo et 89 millions avec un partenaire sud-africain \u2013 durant son mandat de Premier ministre.<\/p>\n\n\n\n<p>Condamn\u00e9 \u00e0 10 ans de travaux forc\u00e9s, \u00e0 l\u2019in\u00e9ligibilit\u00e9 pour 5 ans, et faisant face \u00e0 une ordonnance d\u2019arrestation ainsi qu\u2019\u00e0 la saisie de ses biens, l\u2019ancien dirigeant avait introduit ce recours depuis l\u2019exil, selon son parti, Les G\u00e9n\u00e9rations durables (LGD).<\/p>\n\n\n\n<p>Franklin Tshamala, secr\u00e9taire g\u00e9n\u00e9ral du LGD, avait affirm\u00e9 que Matata avait \u00e9t\u00e9 \u00ab contraint \u00e0 l\u2019exil en violation de l\u2019article 30 de la Constitution \u00bb, d\u00e9non\u00e7ant une man\u0153uvre politique pour l\u2019\u00e9carter de la sc\u00e8ne nationale.<\/p>\n\n\n\n<p>La d\u00e9cision de ce jeudi cl\u00f4t \u2013 sauf rebondissement inattendu \u2013 le volet judiciaire de cette affaire embl\u00e9matique, souvent per\u00e7ue comme un test pour l\u2019\u00c9tat de droit en RDC.<\/p>\n\n\n\n<p><strong>Par Marc Etumba, correspondant \u00e0 Kinshasa<br>CONGO PUB Online<\/strong><\/p>\n<div class='epvc-post-count'><span class='epvc-eye'><\/span>  <span class=\"epvc-count\"> 291<\/span><span class='epvc-label'> Vues<\/span><\/div>","protected":false},"excerpt":{"rendered":"<p>La Cour constitutionnelle de la RDC s\u2019est d\u00e9clar\u00e9e incomp\u00e9tente ce jeudi pour examiner le recours en inconstitutionnalit\u00e9 d\u00e9pos\u00e9 par l\u2019ancien Premier ministre Augustin Matata Ponyo, condamn\u00e9 en mai dernier \u00e0&hellip;<\/p>\n","protected":false},"author":1,"featured_media":88167,"comment_status":"closed","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"content-type":"","_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[844,62],"tags":[],"class_list":["post-88166","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-a-la-une","category-societe"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v25.4 (Yoast SEO v25.4) -
