La Cour de cassation a rendu son verdict tr\u00e8s attendu ce mardi en condamnant l’ancien ministre de la Justice Constant Mutamba \u00e0 trois ans de travaux forc\u00e9s et \u00e0 cinq ans d’interdiction du droit de vote et d’\u00e9ligibilit\u00e9 pour d\u00e9tournement de fonds publics.<\/p>\n\n\n\n

L’ancien garde des Sceaux, reconnu coupable d’avoir soustrait 19 millions de dollars destin\u00e9s \u00e0 la construction d’une prison \u00e0 Kisangani, a \u00e9t\u00e9 imm\u00e9diatement escort\u00e9 hors de l’audience par les forces de l’ordre apr\u00e8s l’annonce du jugement, sous haute s\u00e9curit\u00e9 dans le palais de justice de la Gombe.<\/p>\n\n\n\n

Une condamnation lourde de cons\u00e9quences<\/strong><\/p>\n\n\n\n

Outre la peine d’emprisonnement, la sanction de d\u00e9ch\u00e9ance \u00e9lectorale pour cinq ans signifie que Mutamba, figure montante de l’opposition, sera absent du paysage politique congolais pour la prochaine pr\u00e9sidentielle.<\/p>\n\n\n\n

Un symbole politique ambivalent<\/strong><\/p>\n\n\n\n

Le verdict intervient dans un contexte tendu, marqu\u00e9 par des manifestations de soutien \u00e0 Mutamba violemment dispers\u00e9es la veille. Pour ses partisans, l’ancien ministre incarne une jeunesse non-conformiste qui a os\u00e9 \u00ab\u00a0dire non\u00a0\u00bb et d\u00e9fier l’establishment, notamment en initiant des proc\u00e9dures judiciaires contre l’ancien pr\u00e9sident Joseph Kabila.<\/p>\n\n\n\n

Ses d\u00e9tracteurs, cependant, voient en lui un populiste dont les actions, bien que pr\u00e9sent\u00e9es comme une volont\u00e9 de r\u00e9forme, restaient empruntes d’opportunisme.<\/p>\n\n\n\n

L’ombre de l’affaire Kabila<\/strong><\/p>\n\n\n\n

Ce verdict survient \u00e0 quelques jours seulement de la d\u00e9cision attendue dans le proc\u00e8s que Mutamba avait lui-m\u00eame initi\u00e9 contre Joseph Kabila, ajoutant une dimension politique forte \u00e0 cette condamnation. Beaucoup y voient un \u00e9pisode de plus dans les luttes de pouvoir qui traversent la classe politique congolaise.<\/p>\n\n\n\n

La condamnation de Constant Mutamba marque un tournant judiciaire et politique, cristallisant les divisions et les espoirs d’une g\u00e9n\u00e9ration qui aspire au changement, mais dont les m\u00e9thodes restent vivement contest\u00e9es.<\/p>\n\n\n\n
