L\u2019ancien ministre de la Justice, Constant Mutamba, a essuy\u00e9 un revers judiciaire ce vendredi. La Cour constitutionnelle a rejet\u00e9 les deux recours qu\u2019il avait d\u00e9pos\u00e9s dans le cadre d\u2019un contr\u00f4le de constitutionnalit\u00e9, lors d\u2019une audience publique tenue dans la journ\u00e9e.<\/p>\n\n\n\n

Si la Haute juridiction a reconnu la recevabilit\u00e9 formelle des requ\u00eates, elle a estim\u00e9, apr\u00e8s examen, que les arguments soulev\u00e9s par l\u2019ancien ministre \u00ab n\u2019attestaient d\u2019aucune violation av\u00e9r\u00e9e de la Constitution \u00bb. En cons\u00e9quence, les deux recours ont \u00e9t\u00e9 rejet\u00e9s en leur fond.<\/p>\n\n\n\n

Les d\u00e9tails pr\u00e9cis des recours et des dispositions contest\u00e9es n\u2019ont pas \u00e9t\u00e9 imm\u00e9diatement rendus publics dans le communiqu\u00e9 de la Cour. Cependant, ce rejet marque la fin de cette voie de recours pour Constant Mutamba sur les questions constitutionnelles qu\u2019il avait soulev\u00e9es.<\/p>\n\n\n\n

L\u2019int\u00e9ress\u00e9 contestait notamment la r\u00e9gularit\u00e9 du vote parlementaire ayant conduit \u00e0 sa mise en accusation. Ces arguments ont \u00e9t\u00e9 \u00e9cart\u00e9s par la Cour. Poursuivi pour d\u00e9tournement de fonds publics li\u00e9s \u00e0 la construction d\u2019une prison \u00e0 Kisangani, Constant Mutamba a \u00e9t\u00e9 condamn\u00e9 \u00e0 trois ans de prison, une d\u00e9cision d\u00e9sormais confirm\u00e9e sur le plan constitutionnel.<\/p>\n\n\n\n
