Son interpellation, li\u00e9e \u00e0 une publication sur les r\u00e9seaux sociaux, suscite un d\u00e9bat sur la libert\u00e9 d\u2019expression en R\u00e9publique d\u00e9mocratique du Congo.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-une-arrestation-liee-a-un-tweet\">Une arrestation li\u00e9e \u00e0 un tweet<\/h3>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"768\" height=\"1024\" src=\"https:\/\/congopubonline.com\/wp-content\/uploads\/2026\/04\/image-64.png\" alt=\"\" class=\"wp-image-95882\" style=\"width:593px;height:auto\" srcset=\"https:\/\/congopubonline.com\/wp-content\/uploads\/2026\/04\/image-64.png 768w, https:\/\/congopubonline.com\/wp-content\/uploads\/2026\/04\/image-64-225x300.png 225w, https:\/\/congopubonline.com\/wp-content\/uploads\/2026\/04\/image-64-585x780.png 585w\" sizes=\"(max-width: 768px) 100vw, 768px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Contact\u00e9 par la presse, Me Iyenda affirme que la proc\u00e9dure engag\u00e9e contre lui fait suite \u00e0 un message publi\u00e9 sur les r\u00e9seaux sociaux dans lequel il qualifiait le ministre de la Justice d\u2019\u00ab incomp\u00e9tent \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab J\u2019avais fait un tweet traitant le Ministre de la Justice d\u2019incomp\u00e9tent. [\u2026] On me recherchait pendant pr\u00e8s d\u2019une semaine avant mon arrestation \u00bb, a-t-il d\u00e9clar\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Selon ses propres explications, un avis de recherche aurait \u00e9t\u00e9 \u00e9mis \u00e0 son encontre \u00e0 la suite de cette publication.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-le-ministere-de-la-justice-dement-toute-implication\">Le minist\u00e8re de la Justice d\u00e9ment toute implication<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ces affirmations sont toutefois contest\u00e9es par une source proche du ministre de la Justice, Guillaume Ngefa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">D\u2019apr\u00e8s cette source, aucune plainte ni instruction n\u2019aurait \u00e9t\u00e9 initi\u00e9e par le garde des Sceaux. Le parquet aurait agi de mani\u00e8re autonome, en se saisissant d\u2019office conform\u00e9ment \u00e0 ses pr\u00e9rogatives l\u00e9gales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cette divergence de versions alimente les interrogations sur l\u2019origine r\u00e9elle des poursuites.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-une-defense-fondee-sur-la-liberte-d-expression\">Une d\u00e9fense fond\u00e9e sur la libert\u00e9 d\u2019expression<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Lors de son audition devant le magistrat instructeur, Me Iyenda a reconnu \u00eatre l\u2019auteur des propos incrimin\u00e9s, tout en invoquant le droit \u00e0 la libert\u00e9 d\u2019expression.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019affaire relance ainsi le d\u00e9bat sur les limites de la critique politique en RDC, notamment lorsqu\u2019elle vise des membres du gouvernement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-une-dimension-politique-assumee\">Une dimension politique assum\u00e9e<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Interrog\u00e9 sur ses relations avec Constant Mutamba, l\u2019avocat a rejet\u00e9 toute instrumentalisation politique :<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab Si vous voulez m\u2019arr\u00eater parce que je suis l\u2019ami de Mutamba, soyez clair \u00bb, a-t-il d\u00e9clar\u00e9, questionnant le droit pour une personne condamn\u00e9e de conserver des liens sociaux et amicaux.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-la-societe-civile-interpelle-le-ministre\">La soci\u00e9t\u00e9 civile interpelle le ministre<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Dans ce contexte, une organisation de la soci\u00e9t\u00e9 civile a appel\u00e9 publiquement le ministre de la Justice \u00e0 intervenir en faveur de la lib\u00e9ration de l\u2019avocat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans une d\u00e9claration, elle rappelle le parcours de Guillaume Ngefa en mati\u00e8re de d\u00e9fense des droits humains et estime que son image pourrait \u00eatre affect\u00e9e par une affaire per\u00e7ue comme r\u00e9pressive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Elle souligne notamment que, m\u00eame en l\u2019absence d\u2019implication directe du ministre, une intervention de sa part permettrait de \u00ab pr\u00e9server la cr\u00e9dibilit\u00e9 d\u00e9mocratique \u00bb du pays.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-un-test-pour-l-etat-de-droit\">Un test pour l\u2019\u00c9tat de droit<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Au-del\u00e0 du cas individuel de Me Iyenda, cette affaire met en lumi\u00e8re les tensions persistantes entre libert\u00e9 d\u2019expression, responsabilit\u00e9 p\u00e9nale et ind\u00e9pendance du minist\u00e8re public en RDC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Elle pourrait constituer un test significatif pour l\u2019\u00e9quilibre entre autorit\u00e9 judiciaire et libert\u00e9s fondamentales dans le pays.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Par Pascal Kabeya<br>CONGO PUB Online<\/strong><\/p>\n<div class='epvc-post-count'><span class='epvc-eye'><\/span>  <span class=\"epvc-count\"> 114<\/span><span class='epvc-label'> Vues<\/span><\/div>","protected":false},"excerpt":{"rendered":"<p>L\u2019avocat et acteur politique Manix Iyenda Iyenda, connu pour avoir d\u00e9fendu l\u2019ancien ministre Constant Mutamba, est actuellement d\u00e9tenu \u00e0 la Prison centrale de Makala.
