Le pr\u00e9sident de la R\u00e9publique, F\u00e9lix-Antoine Tshisekedi Tshilombo<\/strong>, a saisi le Parlement pour demander une nouvelle d\u00e9lib\u00e9ration de la proposition de loi fixant les conditions d\u2019organisation du r\u00e9f\u00e9rendum en R\u00e9publique d\u00e9mocratique du Congo.<\/p>\n\n\n\n

L\u2019information a \u00e9t\u00e9 rendue publique ce jeudi 13 ao\u00fbt 2026 par le Bureau de l\u2019Assembl\u00e9e nationale, dans un communiqu\u00e9 sign\u00e9 par son rapporteur, Jacques Djoli<\/strong>. Selon ce document, le chef de l\u2019\u00c9tat a adress\u00e9, le 10 ao\u00fbt, une lettre aux pr\u00e9sidents de l\u2019Assembl\u00e9e nationale et du S\u00e9nat afin de solliciter cette nouvelle d\u00e9lib\u00e9ration, conform\u00e9ment \u00e0 l\u2019article 137 de la Constitution.<\/p>\n\n\n\n

Une demande motiv\u00e9e par l\u2019arr\u00eat de la Cour constitutionnelle<\/strong><\/h3>\n\n\n\n

Cette d\u00e9marche intervient apr\u00e8s l\u2019arr\u00eat R.Const. 2695<\/strong>, rendu le 28 juillet dernier par la Cour constitutionnelle. Celle-ci avait d\u00e9clar\u00e9 la loi conforme \u00e0 la Constitution, tout en formulant plusieurs r\u00e9serves n\u00e9cessitant la suppression, la substitution ou encore la r\u00e9\u00e9criture de certaines dispositions.<\/p>\n\n\n\n

Dans son communiqu\u00e9, l\u2019Assembl\u00e9e nationale explique que le pr\u00e9sident de la R\u00e9publique souhaite que le texte pr\u00e9sente toutes les garanties n\u00e9cessaires en mati\u00e8re de clart\u00e9, de coh\u00e9rence, d\u2019intelligibilit\u00e9 et de s\u00e9curit\u00e9 juridique.<\/p>\n\n\n\n

La Cour constitutionnelle avait formul\u00e9 treize r\u00e9serves d\u2019interpr\u00e9tation<\/strong> concernant certaines dispositions du texte relatif \u00e0 l\u2019organisation du r\u00e9f\u00e9rendum.<\/p>\n\n\n\n

Le texte reviendra devant le Parlement en septembre<\/strong><\/h3>\n\n\n\n

\u00c0 la suite de la requ\u00eate pr\u00e9sidentielle, le Bureau de l\u2019Assembl\u00e9e nationale annonce que la proposition de loi sera de nouveau inscrite au calendrier parlementaire lors de la prochaine session, pr\u00e9vue en septembre 2026.<\/p>\n\n\n\n

Les d\u00e9put\u00e9s et s\u00e9nateurs devront ainsi proc\u00e9der \u00e0 une nouvelle d\u00e9lib\u00e9ration afin de prendre en compte les observations formul\u00e9es par la juridiction constitutionnelle.<\/p>\n\n\n\n

Cette proc\u00e9dure constitue une nouvelle \u00e9tape dans le processus l\u00e9gislatif entourant l\u2019organisation \u00e9ventuelle d’un r\u00e9f\u00e9rendum en RDC.<\/p>\n\n\n\n

Une d\u00e9cision politiquement sensible<\/strong><\/h3>\n\n\n\n

La d\u00e9marche pr\u00e9sidentielle intervient toutefois dans un contexte politique particuli\u00e8rement tendu. La question de la Constitution et celle du r\u00e9f\u00e9rendum se trouvent au c\u0153ur du bras de fer entre le pouvoir et une partie de l\u2019opposition, notamment dans le cadre des discussions sur un \u00e9ventuel dialogue national.<\/p>\n\n\n\n

La coalition C64<\/strong>, qui regroupe notamment Martin Fayulu, Mo\u00efse Katumbi, Jean-Marc Kabund, Delly Sesanga et Augustin Matata Ponyo<\/strong>, a clairement plac\u00e9 la d\u00e9fense de la Constitution parmi ses principales lignes rouges.<\/p>\n\n\n\n

La plateforme d\u2019opposition avait notamment annonc\u00e9 de nouvelles actions politiques apr\u00e8s le 15 ao\u00fbt si le pouvoir ne r\u00e9pondait pas favorablement \u00e0 ses revendications concernant l\u2019ouverture d\u2019un dialogue national inclusif.<\/p>\n\n\n\n

Le communiqu\u00e9 de l\u2019Assembl\u00e9e nationale ne fait cependant aucun lien entre la demande de nouvelle d\u00e9lib\u00e9ration du pr\u00e9sident Tshisekedi et l\u2019\u00e9ch\u00e9ance politique fix\u00e9e par la C64.<\/p>\n\n\n\n

Le d\u00e9bat sur le r\u00e9f\u00e9rendum reste ouvert<\/strong><\/h3>\n\n\n\n

La nouvelle d\u00e9lib\u00e9ration annonc\u00e9e pour septembre ne signifie donc pas, \u00e0 elle seule, qu\u2019un r\u00e9f\u00e9rendum sera organis\u00e9. Elle concerne d\u2019abord le cadre l\u00e9gal destin\u00e9 \u00e0 d\u00e9terminer les conditions dans lesquelles une telle consultation pourrait \u00eatre organis\u00e9e.<\/p>\n\n\n\n

Elle intervient n\u00e9anmoins \u00e0 un moment o\u00f9 la question d\u2019une \u00e9ventuelle r\u00e9vision ou modification de la Constitution cristallise les tensions politiques.<\/p>\n\n\n\n

Pour le pouvoir, la mise en place d\u2019un cadre juridique clair et s\u00e9curis\u00e9 constitue une n\u00e9cessit\u00e9 institutionnelle. Pour une partie de l\u2019opposition, en revanche, toute d\u00e9marche susceptible d\u2019ouvrir la voie \u00e0 une modification de la Constitution, voire \u00e0 un r\u00e9f\u00e9rendum constitutionnel, demeure une ligne rouge.<\/p>\n\n\n\n

La session parlementaire de septembre s\u2019annonce ainsi comme une nouvelle s\u00e9quence importante du d\u00e9bat institutionnel congolais. Au-del\u00e0 de la proc\u00e9dure l\u00e9gislative, c\u2019est d\u00e9sormais la port\u00e9e politique de cette loi et son \u00e9ventuelle utilisation dans le processus constitutionnel qui devraient continuer \u00e0 alimenter les d\u00e9bats entre le pouvoir et l\u2019opposition.<\/p>\n\n\n\n
